1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the AQAR property management platform ("Service"), operated by Chwezi Core Systems Limited ("Company", "we", "us", or "our"), a company registered in Uganda with offices at Sserumaga Road, Bukoto, Kampala.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Service Description
AQAR is a cloud-based property management platform that provides tools for rent collection, tenant management, maintenance tracking, financial reporting, and portfolio management. The Service is accessed via web browser and does not require local software installation.
3. Account Registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4. Demo Access
We provide a free demonstration version of the Service at property.chwezi.co.za. Demo access does not require registration and is provided for evaluation purposes only. Data entered into the demo environment may be reset periodically without notice.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any illegal or unauthorised purpose
- Attempt to gain unauthorised access to any part of the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Upload or transmit viruses, malware, or any other malicious code
- Use the Service to store or transmit any content that infringes upon the rights of any third party
- Reverse engineer, decompile, or disassemble any aspect of the Service
6. Data Ownership
You retain all rights to the data you enter into the Service ("Your Data"). We do not claim ownership of Your Data. You grant us a limited licence to process, store, and display Your Data solely for the purpose of providing the Service to you.
7. Data Security
We implement reasonable technical and organisational measures to protect Your Data against unauthorised access, alteration, disclosure, or destruction. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Payment Terms
Certain features of the Service require a paid subscription. Fees are billed in advance on a monthly or annual basis as agreed. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' written notice.
9. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavour to provide reasonable notice of planned maintenance.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.
Our total liability for any claims arising under these Terms shall not exceed the amount you have paid to us for the Service during the twelve (12) months preceding the claim.
11. Termination
Either party may terminate the use of the Service at any time. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately. We will provide reasonable opportunity for you to export Your Data before deletion.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Uganda. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Uganda.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
